In a big victory for the City of San Mateo, on April 6, 2015, David Rosenbaum and Stephanie Zeller completed a six day trial defending the City of San Mateo against two claims for dangerous condition brought by one plaintiff.

After 13 witnesses and four hours of deliberation, the San Mateo County jury of six men and six women returned a defense verdict on both claims.  In both cases the jury found the conditions were dangerous, but in the first case the 9-3 decision found that the incident was not reasonably foreseeable.

In the second incident, the jury was unanimous in finding that the City did not have notice of the condition. Because the City was the prevailing party, plaintiff was ordered to pay over $45,00 in costs back to the City.
